1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) govern your access to and use of the website located at TeamWWF.org (the “Site”), owned and operated by Wings and Wheels Foundation, a 501(c)(3) charitable organization (EIN 93-1688394) (“Wings and Wheels Foundation,” “TeamWWF,” “we,” “us,” or “our”). By accessing or using the Site, making a donation, purchasing tickets or event experiences, submitting a driver application, or otherwise interacting with our programs through the Site, you (“you” or “user”) agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site.

These Terms apply in addition to our Privacy Policy, which is incorporated by reference. If a Privacy Policy is not yet published on the Site, one should be adopted before the Site collects any personal or payment information.

2. ABOUT WINGS AND WHEELS FOUNDATION

Wings and Wheels Foundation is a nonprofit organization that identifies promising, diverse young drivers and helps place them in supportive environments with motorsports professionals, providing coaching, resources, and opportunities to advance their racing careers. Through the Site, we provide information about our mission and programs (including Driver Support, Adopt-a-Driver, STEM Labs, Safe Driving Clinics, and the Ambassador Program), accept charitable donations, facilitate sponsorship and partnership inquiries, promote ticket and hospitality opportunities at motorsports events (such as the TeamWWF VIP Suite at the Indianapolis Motor Speedway), and enable prospective driver applications and nominations.

3. ELIGIBILITY AND ACCOUNT USE

The Site is intended for users who are at least 18 years old, or who are using the Site under the supervision of a parent or legal guardian. If you are under 18, you may use the Site only with the involvement and consent of a parent or guardian, particularly in connection with driver program applications or nominations. You agree to provide accurate, current, and complete information when submitting forms, applications, or donations through the Site, and to promptly update such information as needed.

4. USE OF THE SITE

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

(a) use the Site in any way that violates applicable local, state, national, or international law or regulation;
(b) attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems connected to the Site;
(c) transmit any viruses, malware, or other harmful code;
(d) use any automated system (bots, scrapers, spiders) to access the Site without our prior written consent;
(e) impersonate any person or entity, or misrepresent your affiliation with any person or entity, including Wings and Wheels Foundation, its drivers, sponsors, or partners;
(f) submit false, misleading, or fraudulent information in any donation, application, ticket request, or sponsorship inquiry; or
(g) interfere with or disrupt the operation of the Site or servers/networks connected to it.

We reserve the right to restrict, suspend, or terminate your access to the Site, in whole or in part, at any time and without notice, for any conduct that we believe violates these Terms or is otherwise harmful to Wings and Wheels Foundation, its drivers, donors, partners, or other users.

5. DONATIONS AND PAYMENTS

5.1 Third-Party Payment Processing. Donations made through the Site are processed via GiveButter, a third-party nonprofit donor management and payment platform. Wings and Wheels Foundation does not directly store or process your payment card information; such information is handled by GiveButter and/or its payment processors in accordance with their own terms of service and privacy policies, which you should review prior to donating.

5.2 Tax-Deductibility. Wings and Wheels Foundation is a 501(c)(3) tax-exempt charitable organization (EIN 93-1688394). Donations may be tax-deductible to the extent permitted by applicable law; however, we do not provide tax, legal, or financial advice, and you should consult your own tax advisor regarding the deductibility of any contribution. A donation receipt or acknowledgment will be provided in accordance with applicable IRS requirements.

5.3 Recurring Donations. If you elect to make a recurring donation, you authorize Wings and Wheels Foundation and/or GiveButter to charge your designated payment method on a recurring basis until you cancel. You may cancel or modify a recurring donation at any time by contacting us using the information in Section 12 or through your GiveButter donor account, if applicable.

5.4 Refunds. Donations are generally non-refundable. If you believe a donation was made in error (for example, a duplicate transaction or unauthorized charge), please contact us promptly at director@teamwwf.com, and we will review the request in good faith. Refunds, if granted, are issued at our sole discretion and in compliance with applicable law.

5.5 No Goods or Services. Except where expressly stated (such as event tickets, hospitality packages, or merchandise), donations do not entitle the donor to any goods or services in return.

6. EVENT TICKETS, VIP SUITE, AND HOSPITALITY EXPERIENCES

From time to time, the Site may promote or facilitate access to motorsports event tickets, hospitality packages, or experiences such as the TeamWWF Turn 2 VIP Suite at the Indianapolis Motor Speedway. Unless otherwise stated:

(a) Ticket sales and event access are often provided or fulfilled by third parties (such as the venue, event organizer, or ticketing platform), and your purchase or attendance may be subject to those third parties’ own terms, conditions, and policies, including admission, refund, and cancellation policies;
(b) Pricing, availability, and rental information for hospitality packages (such as the VIP Suite) are provided upon inquiry and are subject to change without notice;
(c) Wings and Wheels Foundation is not responsible for event cancellations, postponements, venue conduct, weather conditions, or other circumstances beyond our reasonable control; and
(d) All hospitality and event guests are expected to comply with venue rules and applicable law, and Wings and Wheels Foundation reserves the right to deny or revoke access for conduct it deems inappropriate or unsafe.

7. DRIVER PROGRAMS, SPONSORSHIP, AND PARTNERSHIP INQUIRIES

7.1 Driver Applications. Submitting a driver application, nomination, or inquiry through the Site (including for scholarships, the Ambassador Program, or related initiatives) does not guarantee selection, funding, sponsorship, or any other outcome. Selection decisions are made at the sole discretion of Wings and Wheels Foundation and any applicable selection panel, and are based on criteria we determine from time to time, including sportsmanship, character, and on-track performance.

7.2 Sponsorship and Partnership Inquiries. Information submitted through sponsorship, partnership, or “partner with us” forms is used solely to evaluate and respond to potential business or philanthropic relationships. Submission of an inquiry does not create any binding obligation on either party unless and until a separate written agreement is executed.

7.3 No Employment Relationship. Participation in Wings and Wheels Foundation programs (including as a driver, ambassador, or volunteer) does not create an employment, agency, or partnership relationship with Wings and Wheels Foundation unless expressly stated in a separate written agreement.

8. INTELLECTUAL PROPERTY

All content on the Site, including text, graphics, logos, images, driver profiles, photographs, videos, and the overall look and feel of the Site (collectively, “Content”), is owned by or licensed to Wings and Wheels Foundation and is protected by U.S. and international copyright, trademark, and other intellectual property laws. “Wings and Wheels Foundation,” “TeamWWF,” and associated logos are trademarks or service marks of Wings and Wheels Foundation. You may view, download, and print Content solely for your personal, non-commercial use, provided you do not remove any copyright, trademark, or other proprietary notices. Any other use, including reproduction, modification, distribution, republication, or commercial exploitation of Content, without our prior written consent, is prohibited.

9. USER SUBMISSIONS

If the Site allows you to submit content (such as testimonials, comments, photos, or messages), you grant Wings and Wheels Foundation a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display such content in connection with our mission, programs, marketing, and fundraising activities. You represent that you own or have the necessary rights to any content you submit and that it does not violate any third party’s rights or applicable law. We reserve the right to remove any user-submitted content at our discretion.

10. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites and services, including but not limited to GiveButter, ticketing platforms, the Indianapolis Motor Speedway, social media platforms, sponsor websites, and driver-affiliated sites. These links are provided for convenience only. Wings and Wheels Foundation does not control and is not responsible for the content, privacy practices, or terms of any third-party site, and inclusion of a link does not imply endorsement. Your use of any third-party site is at your own risk and subject to that site’s own terms and policies.

11. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WINGS AND WHEELS FOUNDATION DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SITE, INCLUDING PROGRAM, EVENT, OR DRIVER INFORMATION.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, WINGS AND WHEELS FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DONATIONS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, ANY DONATION OR PAYMENT MADE THROUGH IT, ANY EVENT OR HOSPITALITY EXPERIENCE PROMOTED THROUGH IT, OR ANY THIRD-PARTY SITE OR SERVICE LINKED FROM IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT DISCLAIMED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Wings and Wheels Foundation and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information, including information submitted through donation, application, and inquiry forms. By using the Site, you consent to the practices described in the Privacy Policy. If the Site processes payment card data or personal information from residents of jurisdictions with specific privacy laws (e.g., the CCPA in California), Wings and Wheels Foundation should ensure its Privacy Policy and data-handling practices comply with those requirements.

15. INDIANA CHARITABLE SOLICITATION COMPLIANCE

Wings and Wheels Foundation is organized and primarily operates in Indiana, primarily conducting charitable solicitation activities. Depending on donors’ locations, additional state charitable solicitation disclosures may apply. Nothing in these Terms limits any disclosures Wings and Wheels Foundation is required to make under applicable charitable solicitation laws.

16. CHANGES TO THESE TERMS

We may revise these Terms from time to time at our sole discretion. The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. TERMINATION

We reserve the right to suspend or terminate your access to all or part of the Site, without notice, for conduct that we believe violates these Terms, applicable law, or is otherwise harmful to Wings and Wheels Foundation, its drivers, donors, or other users. Sections of these Terms that by their nature should survive termination (including Sections 8, 11, 12, 13, and 18) will survive.

18. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction of such courts. 19. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Wings and Wheels Foundation regarding use of the Site.
